Ordering Process for Soundware and Audio

You can purchase our audio or sound-ware online via our online store, Payhip. To place an order use the blue 'add to cart' or the white 'buy it now' button to add the selection to your basket and then choose one of the payment options you will find in the Payment option section of the form. All major credit and debit cards are accepted. We also use PayPal - you do not need a PayPal account to purchase.

After you have placed your Online Order, your download links will be available immediately * via e-mail (normally within a few minutes after placing your order).

* Payments via PayPal can take a little longer due to their processing system.

You will receive your download links and an invoice from Payhip. You will also receive a confirmation of your order directly from Jamyama Studios at about the same time, including your download links.

Please note that we are unable to provide refunds or exchanges for sound-ware and audio, therefore it is important to for you to make use of our preview functions to make sure the product is absolutely fit for your requirement. See our refund policy below for more information.

Your download will be delivered as a ZIP file and will contain the product that you purchased along with a licence agreement and a readme text file for that product.

1. Definitions

2. Conditions

2.1 These Conditions shall form the basis of the contract between the Seller and the Buyer in relation to the sale of Audio and Soundware Licences, to the exclusion of all other terms and conditions including the Buyer’s standard conditions of purchase or any other conditions which the Buyer may purport to apply under any purchase order or confirmation of order or any other document.

2.2 All orders for Audio and Soundware Licences shall be deemed to be an offer by the Buyer to purchase Audio and Soundware Licences from the Seller pursuant to these Conditions.

2.3 Acceptance of delivery of the Audio and Soundware Licences shall be deemed to be conclusive evidence of the Buyer’s acceptance of these Conditions.

2.4 These Conditions may not be varied except by the written agreement of the Seller.

2.5 These Conditions, along with the Audio and Soundware Licence and Copyright Statement represent the whole of the agreement between the Seller and the Buyer. They supersede any other conditions previously issued.

3. Price

The Price shall be the price quoted on the Seller’s website. The Price is shown inclusive and exclusive of VAT, due at the rate in force on the date of the Seller’s invoice.

4. Payment

4.1 Payment of the Price and VAT shall be paid upon completion of the online process.

4.2 The Buyer shall pay all accounts in full and not exercise any rights of set-off or counter-claim against invoices submitted by the Seller.

5. Audio and Soundware Licences

The quantity and description of the Audio and Soundware Licences shall be as set out in the Seller’s online confirmation of order.

6. Warranties

The Seller warrants that the Audio and Soundware Licences will at the time of delivery correspond to the description given by the Seller as detailed on the Sellers website and in the confirmation of order. [Except where the Buyer is dealing as a consumer (as defined in section 12 of the Unfair Contract Terms Act 1977), all other warranties, conditions or terms relating to fitness for purpose, quality or condition of the Audio and Soundware Licences are excluded].

7. Delivery of the Audio and Soundware Licences

7.1 Delivery of the Audio and Soundware Licences shall be made via both a download link, which is made available directly after purchase and also to the Buyer’s email address. The Buyer shall make all arrangements necessary to take delivery by way of download of the Audio and Soundware Licences to a computer or other capable device.

7.2 The Seller undertakes to use its reasonable endeavours to email the Audio and Soundware links, but does not guarantee to do so. Time of delivery shall not be of the essence of the contract.

7.3 The Seller shall not be liable to the Buyer for any loss or damage whether arising directly or indirectly from the late delivery or short delivery of the Audio and Soundware Licences. If short delivery does take place, the Buyer undertakes not to reject the Audio and Soundware Licences but to accept the Audio and Soundware Licences delivered as part performance of the contract.

7.4 If the Buyer fails to take delivery of the Audio and Soundware Licences due to system or other technical failure, arrangement will be sought to find an alternative method of delivery. In order to remedy this, it is important for the Buyer to email support@jamyama.com stating order details and reasons for difficulty.

8. Acceptance of the Audio and Soundware Licences

8.1 The Buyer shall be deemed to have accepted the Audio and Soundware Licences [48 hours] after delivery to the Buyer.

8.2 The Buyer shall carry out a thorough inspection of the Audio and Soundware Licences using the preview system on the website to determine suitability for purpose and within [48 hours] of delivery and shall give written notification to the Seller within 5 working days of delivery of the Audio and Soundware Licences of any defects which a reasonable examination would have revealed.

8.3 Where the Buyer has accepted, or has been deemed to have accepted, the Audio and Soundware Licences the Buyer shall not be entitled to reject Audio and Soundware Licences which are not in accordance with the contract.

9. Title and risk

9.1 Risk shall pass on delivery of the Audio and Soundware Licences to the Buyer’s address.

9.2 Notwithstanding the earlier passing of risk, title in the Audio and Soundware Licences shall remain with the Seller and shall not pass to the Buyer until the amount due under the invoice for them has been paid in full.

9.3 Until title passes the Buyer shall hold the Audio and Soundware Licences as bailee for the Seller and shall store or mark them so that they can at all times be identified as the property of the Seller.

9.4 The Seller may at any time before title passes and without any liability to the Buyer:

9.4.1 repossess and dismantle and use or sell all or any of the Audio and Soundware Licences and by doing so terminate the Buyer’s right to use, sell or otherwise deal in them; and

9.4.2 for that purpose (or determining what, if any, Audio and Soundware Licences are held by the Buyer and inspecting them) enter any premises of or occupied by the Buyer.

9.5 The Seller may maintain an action for the price of any Audio and Soundware Licences notwithstanding that title in them has not passed to the Buyer.

10. Carriage of Audio and Soundware Licences

Jamyama Studios currently only deal with digital downloads therefore, Audio and Soundware Licences and associated files have no carriage charges.


Refund Policy

UK Distance Selling Regulations (June 2014) would normally give you the right to cancel a contract of sale within 7 days. This does not however apply to downloadable music, audio and soundware, because after the products have been downloaded to your computer, they cannot be returned as you have full access to them.

Furthermore, when you buy our music, audio or soundware, a license to use them in your productions is transferred to you on completion of your purchase.

After you have downloaded your purchase, you do not have the right to cancel the order. Other rights that you may have are not affected.

If the product you download does not function as intended in some way, please contact us detailing the nature of the problem. If we are not able to rectify the problem within a reasonable time, we will of course be happy to refund your purchase.

If, after downloading and listening to the content of a product, you feel that it is completely unsuitable for your needs and you believe this is because the product's description and preview on our website was misleading, please contact us to discuss the matter.
